FREIGHT POLICY
Freight is prepaid and added to customer’s invoice on all orders. When specific shipping instructions are not given, we shall ship using a common carrier of our choice. Any extra charge incurred for additional services, such as customer's chosen carrier or special handling at the destination, must be paid by customer. Back-ordered goods are shipped immediately upon receipt in our warehouse. Title and risk of loss passes to the customer on delivery to the common carrier.

DAMAGES / SHORTAGE CLAIMS
Customer should inspect order for damage or shortage in goods. If the good was damaged in transit, please note the damage on the delivery receipt and obtain an inspection report from the truck line immediately. Then notify our Customer Service at 800-989-0836 within 3 business days or customer will be deemed to accept the good pursuant to Texas Business & Commerce Code §2.606.

SHIPPING HAZARDOUS GOODS
Goods considered hazardous for shipping will require special packaging, handling, and additional shipping charges. For specific details and charges, call 800-989-0836.

PRICES
Any and all prices herein are subject to change without notice. Prices will be confirmed at the time of order.
Prices for large quantities or goods not found in our website are available upon request. Contact Customer Service at 800-989-0836 for assistance.

PAYMENT TERMS
Payment to Saf-T-Glove, Inc. is due prior to shipment of the order; provided, however, that customers with accounts with established credit may pay within 30 days from date of the invoice. To open an account, please contact our Customer Service or complete the credit application form. We accept the following credit cards: American Express, MasterCard or Visa. All payments must be in US dollars.

CREDIT BALANCE
Customer agrees that any credit balances issued to the customer by Saf-T-Glove, Inc. shall be applied to the customer’s account within one (1) year of the credit issuance. If the credit balance is not applied or requested within one year, any remaining balance will be subject to cancellation and Saf-T-Glove, Inc. shall have no further liability to customer for the remaining balance.

SALES TAX
We are required by law to charge and collect state and local sales tax in Texas, Oklahoma, Arkansas, Louisiana, Missouri, Kansas, Colorado, New Mexico and Nevada for all goods, except such goods which have a sales tax exemption certification. At the time of order, please indicate clearly which goods are tax exempt and provide the sales tax exemption certification.

RETURNS
Goods must be returned within 30 days of receipt. Please call our Customer Service for your Return Goods Authorization (RGA) number before returning goods: 800-989-0836. We will fax or email, your choice, a completed RGA form with return instructions. Special order goods or custom imprinted goods are not returnable, unless there is a defect in workmanship or our error. Please enclose a copy of the RGA with the unwanted good(s) and prepay the shipping; we do not accept CODs. All returned goods must be carefully packaged and returned in saleable condition. Returns may be subject to a restocking charge.

LIMITATIONS OF WARRANTIES
The goods that we sell have been manufactured by others and may be warranted for limited periods of time by the manufacturer’s warranty. The manufacturer’s warranty, if any, will be submitted to the Buyer upon request. In the event Buyer should submit a timely and valid claim under such a warranty, Seller agrees to reasonably cooperate in helping to process such a claim.  IN ALL EVENTS, SAF-T-GLOVE, INC. CONVEYS THE GOOD “AS-IS” "WHERE IS", "WITH ALL FAULTS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. No agent, employee or representative of the Seller has any authority to bind the Seller to any affirmation, representation or warranty concerning the goods that we sell beyond that specifically included in a written quotation.  Statistical information contained in good literature supplied by Saf-T-glove, Inc., is derived from table supplied by the manufacturers. We do not assume responsibility for the precise accuracy of such information.

LIMITATIONS OF REMEDIES
The buyer’s sole and exclusive remedy against Saf-T-Glove, Inc. with respect to the contract of sale or anything done in connection therewith shall be limited to return of the goods to Saf-T-Glove, Inc. and repayment of the purchase price by Saf-T-Glove, Inc. to the buyer or repair and replacement by Saf-T-Glove, Inc. of the non-conforming goods.  In no event shall Saf-T-Glove, Inc. be liable to Buyer or any third party for any special, punitive, incidental, indirect or consequential damages of any kind.  Saf-T-Glove, Inc. reserves the right to change the terms and conditions of sales pending notification to the customer.

CONTROLLING LAW; VENUE
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas.  In the event of any dispute, the venue of any action shall be in Tarrant County, Texas, and parties submit to the jurisdiction of any such court.  If legal action is required to enforce these Terms and Conditions, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

CONFLICT WITH TERMS AND CONDITIONS
These Terms and Conditions are incorporated into any contract of sale and in the event any provisions in the Terms and Conditions conflict with the contract of sale, the Terms and Conditions shall control.
